In answer to your question; no, I am not sure of <br />5 that, and I will like to hear discussion on that. <br />6 MR. O'CONNOR: So would I, I am not really sure what <br />7 that means current violation. <br />8 MR. BANTA: I tell you I looked at that statute and I <br />9 don't know what it means. It says, currently found to be in <br />10 violation. I think that means found to be currently in <br />11 violation. I assume that is what it means. I think that it's <br />12 noted that there have been cases in the past that the Board has <br />13 found to be in violation ordered some curative action and then <br />14 issued a subsequent permit or permit amendment. <br />15 CHAIRMAN DANIELSON: I guess what I would say I would <br />16 just simply say that I think that decision doesn't have to be <br />17 made as part as of the notice of violation proceedings. <br />18 And we ought to turn to the question of permit <br />19 amendment and that I think I know it's late, but I think there is <br />20 one thing we absolutely have to address tonight.
