<br />~i <br />zs <br />1 commissioner cease and desist in this case with respect to the <br />2 Williams Canyon rock fall in affect, you almost immediately be in <br />3 a position to lift it because they are no longer pushing these <br />4 rocks in the area done with respect to the access road, if there <br />5 was a cease and desist placed on that, we would have to determine <br />6 exactly what--what would be the trigger to lift that. <br />7 And again, I think it would be ceasing placing material <br />8 on it such a way and to continue the problem and mp understanding <br />9 and discussed it with the operator is that they have already <br />10 ceased that also. <br />11 CHAIRMAN DANIELSON: What's correct if you want to call <br />12 it corrective action, what is corrective action you would <br />13 recommend? <br />14 MR. HERNANDEZ: That was outlined in my inspection <br />15 report. What I recommended was for the west rock fall to be <br />16 drainage. The corrective action that I recommended was that <br />17 reclaim the damage to the slope by reseeding and replacing damage <br />18 or lost trees. <br />19 Removal of rocks from the drainage was not necessary <br />20 and additional disturbances but would disadvantagous to it. As <br />21 to the offsite damage from the access road shoulders, what I said <br />22 was the operator to contact the geotechnical engineer as <br />23 described in Mr. Obering's report regarding the reclamation of <br />24 the sites to provide that geotechnical analysis to the division <br />25 for review by August 21. <br />
