<br /> <br />lz <br />1 and if we find after having heard six and a half hours of <br />2 testimony that this doesn't constitute a violation; three or four <br />3 months from now, we are not happy ,with what Castle is doing to <br />4 remedy that situation, I think we are stuck because I think we <br />5 found that this isn't a violation. <br />6 And to turned around four months from now and to say <br />7 that this same identical situation is now a violation, Z think <br />8 that by finding no violation we give up any handle we gave over <br />9 the situation. And that disturbs me because I want a handle over <br />10 this. <br />11 Second--well, I know while we have discussed at length <br />12 this problem about the audited and voluntary recording; I don't <br />13 think our policy is not to find violations because people report <br />14 themselves. <br />15 Indeed, I remember individually going through that with <br />16 the City of Colorado Springs which set up its own internal <br />17 environmental audit program and discovered that they have an <br />18 unpermitted gravel pit on Pike's Peak Road and came in. And <br />' 19 while we commended them for having done that, we found the <br />20 violation and assessed a civil penalty, although it was a small <br />21 one and we suspended it. <br />22 I think the principal xas there was a violation there, <br />23 and while we gave them some credit for that. I guess the third <br />24 thing I'd say is that in terms of a civil penalty, you know, two <br />25 people can live in that area--map be this Board is just getting <br />
