<br />RULE 1.04(111)(c) <br />DEFINITION OF LIGHT-USE ROADS <br />1.04 DEFINITIONS <br />(111) "Road" means a surface right-of-way for <br />purposes of travel by land vehicles used in coal <br />exploration or surface coal mining and <br />reclamation operations. A road consists of the <br />entire area within the right-of-way, including the <br />roadbed, shoulders, parking and side area, <br />approach structures, ditches, surface, and such <br />contiguous appendages as are necessary for the <br />total structure. The term does not include public <br />roads, pioneer or construction roadways used for <br />part of the road construction procedure and <br />promptly replaced by a haul road, access road, or <br />light-use road located in the identical right-of-way <br />as the pioneer or construction roadway. The <br />terms also excludes any roadway within or <br />adjacent to the immediate mining pit area. <br />(c) "Light-use road" means roads infrequently <br />traveled or used on an intermittent basis for <br />purposes other than transportation of coal <br />including, but not limited to, roads used for <br />monitoring, periodic maintenance of <br />monitoring facilities, or other occasional <br />uses. <br /> <br />
