<br />15. All culverts (with the exception of those along Grassy Creek) wer eliminated and/or <br />replaced with open channel armored road crossings. Rem of the drainage <br />control features was accomplished in accordance with the appro ed reclamation plan. <br />All remaining and existing drainage control features facilitate post-mining land-use <br />of rangeland. Rockcastle has complied with Section N, Part 3 of the Agreement. <br />16. Rockcastle submitted to the Division and implemented an approved drainage and <br />sediment control plan. Ditch repass and modifications have been completed as <br />specified in the approved final reclamation plan and as outlined in information <br />submitted by Rockcastle to the Division on October 16, 1991, November 26, 1991, <br />January 21, 1992, and May 12, 1992. Pond modifications and reclamation has been <br />completed as specified in We approved reclamation plan. Rockcastle has wmplied <br />with Section N, Part 4 of the Agreement <br />17. Rockcas8e submitted to the Division Map R-1, which depicts final site topography <br />generated from an aerial photograph dated 10/16/90. All azeas, except the slope <br />above Pit 4 and pond reclamation at ponds 2 and 3, were in final configuration on <br />the date of the aerial photograph. During subsequent field inspections, the Division <br />confirmed appropriate fnnat contours for a stable, long term configuration of the <br />slope above Pit 4 and the azeas reclaimed at ponds 2 and 3. Rockcastle has <br />complied with Section N, Part 5 of the Agreement. <br />18. Section N, Part 6 of the Agreement addresses timeframes for review of engineering <br />studies required to accomplish reclamation. Said Section is no longer relevant to <br />whether Rockcastle has complied with the terms of the Agreement. <br />19. Section V, Part 1 of the Agreement specified Rockcastle seek the release of bond <br />monies from the Division on a monthly basis. Bond releases were sought on an <br />irregular basis which conformed to the completion of major reclamation components <br />for the site. Rockcastle has complied with Section V, Parts 1-4 of the Agreement. <br />20. The final bond amount to be forfeited by Rockcastle for maintenance of the site <br />through the liability period was modified per a Modification to Agreement, effective <br />August 26, 1992, as signed by Karla Rabuck of Rockcastle Coal Company and <br />Michael Long, Director of the Division of Minerals and Geology. The bond <br />forfeiture was reduced to $25,000.00 from the previous amount of $50,000.00. <br />21. Rockcastle and the Division executed a Modification to the Agreement effective May <br />10, 1993 calling for the retained bond amount set forth in Section V, Parts 2a, 5 and <br />Section VII of the Agreement to be $35,000.00. Rockcastle and the Division agreed <br />that 510,000 of the retained bond amount would be earmarked for noxious weed <br />control in only those azeas at the site disturbed by mining activity. The Modification <br />to Agreement set forth the terms pursuant to which the balance of the earmarked <br />funds would be returned to Rockcastle. <br />3 <br />
