No. C-95-017 <br />I am submitting this letter as a follow-up to our meeting in your Denver office on June 19, <br />1995. Enclosed please find a revised work plan, for your approval, to investigate the causes <br />of the Ashmore Pit landslide. The work plan incorporates the changes we discussed at the <br />meeting. Data collection and analysis proposed in the work plan will be under the direction of <br />Vladimir Straskraba of Hydro-Geo Consultants, Inc. Mr. Straskraba is under contract to <br />Trapper for this project. <br />As discussed, Trapper Mine also requests, pursuant to Rule 5.03.2(2)(c)(iv), that the time <br />allowed for abatement actions to the above-captioned N.O.V. be extended. Specifically, we <br />request that the submittal date for a technical revision (TR) which will provide a remediation <br />plan design for the slide area be extended to August 28. This will allow time to complete <br />landslide data collection and evaluation essential to TR development. We further request that <br />the final abatement requirement be modified to "obtain approval of the TR," and that the dead- <br />line for fmal abatement be extended to October 15, 1995. TR approval should be sufficient to <br />terminate the NOV because Trapper will be obligated to perform the remediation work by our <br />permit at that time In addition, it is impossible at this time to accurately estimate the time <br />needed to complete the work, and therefore, how long to request for a final abatement exten- <br />sion after the TR is approved. Alternately, if the final abatement action is not changed, we <br />request that the deadline for implementation of the remediation plan be extended to the later of <br />October 31 or at least 30 days following Division approval to commence remediation work. <br />The reason for requesting these time extensions is because it is not feasible to complete the <br />abatement actions in the time allowed by the NOV. Recent, extraordinary wet climatic condi- <br />tions have made it impossible to mobilize equipment on the slide area for data collection pur- <br />poses until significant drying occurs. A Trapper Mine survey truck became mired to the <br />bottom of the truck doors on June 15 when attempting to get close to the slide area for survey- <br />ing purposes. Larger excavation equipment needed to dig test pits would encounter even <br />greater problems if we attempt to move in before ground conditions allow. In addition, envi- <br />ronmental harm to topsoil and vegetation resources would occur if mobilization occurs before <br />ground conditions are appropriate.
