Banta, <br />Division Direttor <br />RE: Trinidad Basin Mine (C-81-048), Amended Board Order and Notice <br />of Violation C-91-009 <br />Dear Mr. Mills: <br />This letter is being written to inform you of the outcome of the <br />July 24, 1991 Meeting of the Colorado Mined Land Reclamation Board. <br />As you know the meeting was continued from the May and June <br />meetings to allow additional time for the maintenance to be <br />completed at the Trinidad Basin Mine. On 15 July and 22 July, 1991 <br />inspections were conducted at the mine to determine if the <br />maintenance had been performed to the satisfaction of the November <br />1990 Board Order. It was determined that not all of the Order had <br />been satisfied. <br />Since the order had not been completely complied with, the Board <br />had the option of forfeiting the reclamation bond on file with the <br />Division. However, since part of the Order had been complied with <br />and in the interest of providing the operator with every <br />opportunity to complete the maintenance, the Division presented a <br />new proposal to the Board to allow the operator one more chance to <br />complete the required maintenance. The proposal entailed two parts <br />including: <br />1. Amending the current Board Order to reflect the work that has <br />been accomplished to date and updating what remains to be done and; <br />2. Issuing a Notice of Violation specifically addressing the work <br />that was not completed. This NOV provides an abatement date that <br />coincides with the amended Board Order of September 10, 1991. <br />As a result of these two actions the Board opted for not forfeiting <br />the bond at this time. However, if the maintenance is not performed <br />to the satisification of the Order, the NOV, and the Division by <br />September 10, 1991, the bond will be forfeited. Additionally, <br />Trinidad Basin Mining, Inc. could be issued a Failure to Abate <br />Cessation Order which carries a minimum penalty of $750.00 per day <br />for every day the violation goes unabated. <br />As you can see performing the maintenance by September 10, 1991 is <br />
