a • III IIIIIIIIIIIII III <br />Synopsis u. ~.~„~, .._.._ d) <br />East Douglas Pit, Rio Blanco Co., Permit No. M-87-103 <br />Operator: M. Sims Gravel Company <br />2/26/92 Notice of Violation No. M-92-Oil was issued by the Board to M. Sims <br />Gravel Company for mining and stockpiling outside the permit <br />boundary. A cease and desist order was issued on the site until the <br />corrective actions are completed. As a corrective action the <br />operator must file an amendment to the current mining and <br />reclamation plans to include the additional area of disturbance and <br />receive amendment approval by March 25, 1992. The Board held the <br />consideration of a civil penalty in abeyance until the March Board <br />meeting. <br />Mildred Sims filed an amendment application with the Division which <br />included a surveyed map of the disturbed area. The amendment adds <br />4.4 acres to the 3.0 acres in the original permit. <br />2/28/92 Letter from Senator Wattenberg registering a shocked reaction to the <br />state of affairs at the East Douglas Pit. <br />3/3/92 Date of Amendment newspaper publication. <br />3/4/92 Received a citizen phone complaint that M. Sims Gravel Company had <br />violated the C & D Board Order by shipping from the East Douglas Pit <br />on 2/28/92 and 3/2/92. <br />3/6/92 Ben Steele, Foreman, Rio Blanco County Shop indicated his records <br />show Rio Bianco County hauled 12 loads on 2/28/92 and 16 loads on <br />3/2/92 from the East Douglas Pit (total 332 cu. yds.). He said the <br />Sims owed them some gravel and he did not know about the C & D <br />Order. He said they stopped hauling when he heard about the C & D. <br />3/6/92 BLM, Meeker, Letter to Division that they hold a $6,000.00 bond for <br />assuring royalty payments and reclamation of the site. <br />3/9/92 Copy of current correspondence sent to Senator Wattenberg. <br />3/9/92 Mildred Sims letter to Division - indicated she complied with the <br />C & D Order on 2/21/92. She recounted the elements of the amendment <br />application she had submitted with the Division. <br />3/10/92 Division adequacy review letter sent to Mrs. Sims requiring some <br />additional clarification on the amendment application. <br />3/11/92 Letter of complaint received by Division - shipping of aggregate <br />from East Douglas Pit site on 3/2/92 in violation of the Board's <br />C & D Order. Complaintant also opposed approval of the amendment <br />under consideration by the Division. <br />- Copy of complaint letter mailed to Mrs. Sims. <br />
