.~ <br />PSM has submitted construction information to the <br />Division demonstrating that flow from Diversion Ditch 1 in the <br />Moffat Area will not outlet into Pond S. P&M has further demon- <br />strated that additional erosion control measures are not necessary <br />at the ditch outlet to protect the receiving draw from erosion. <br />The Division has concluded that the information sub- <br />mitted by P&M for Stipulation No, lb satisfies the requirements of <br />the stipulation. Therefore, the Division agrees not to include <br />Stipulation No. lb in the Permit Renewal. <br />P&M agrees to submit the following information within <br />30 days after the date which the Permit Renewal is approved and <br />issued by the Board: <br />(a) Pages 4.6-35 and 36; <br />(b) Location Map No. 4.6-1; <br />(c) Diversion Gitch #1 Cross Sections Map; and <br />(d) Water Flow Calculations. <br />The above four items were submitted by P&M to the <br />Division for preliminary approval in a Non-Revision Stipulation <br />Response dated August 4, 1987. <br />4. P&M hereby withdraws its protest of Stipulation No. lc <br />in the Proposed Decision and agrees that the stipulation shall be <br />-5- <br />
