<br /> <br />Monitoring reports will be submitted to the Division on a <br />quarterly basis. <br />P&M agrees to prepare and submit to the Division for <br />approval, a water monitoring plan proposing to place two water <br />wells in the Moffat Area. The specifics of the ground water <br />monitoring plan will be submitted with the Stipulation No. 1 <br />response. The first well of the monitoring plan will be located <br />in the- area between the sediment pond cutslope and the toe of <br />out-of-pit spoil and will be drilled within a reasonable time <br />after the Permit Renewal is approved and issued by the Board. The <br />second well will be completed in the significant drainage located <br />in the Southwest Quarter (SW;) of Section 30, Township 5 North, <br />Range 85 West. <br />The purpose of these two wells is to monitor pre- and <br />post-mining groundwater pressures in the Lower Wadge and Upper <br />Clay seams to determine the long-term stability of the reclaimed <br />slope. Monitoring data will be collected monthly and reported <br />quarterly once the wells are installed. <br />3. Stipulation No. lb of the Proposed Decision stated: <br />THE APPLICANT b1UST CONSTRUCT DIVERSION DITCH 1 IN THE <br />MOFFAT AREA TO ENSURE THAT FLOW FROM THE DITCH DOES NOT <br />OUTLET INTO POND S. THE APPLICANT MUST ALSO PROVIDE <br />EROSION CONTROL AT THE DITCH OUTLET TO PROTECT THE <br />RECEIVING DRAW FROM EROSION. <br />-4- <br />
