• • <br />Colorado Dept. of Natural Resources re: Lemoine (M-79-140) January 6, 1998 <br />Area B, which also lies outside of the permitted area is actually an area which has been <br />used to dump fill from other construction projects. No gravel, topsoil, waste, or other materials <br />from the Lemoine Pit have been located within this .9 acres. As indicated in the attached letters <br />(from Bruce Bertram and Ralph Clark), this azea has been used as a fill area by the County and by <br />others with the permission of the landowner and because the fill brings the level of the ground up, <br />the arrangement is mutually beneficial to all parties. <br />We respectfully submit, therefore, that neither of these areas shown, nor the original <br />suspicion as set forth in my original letter, would constitute a violation of the permit and further <br />respectfully request that charges be dismissed and the hearing vacated with respect to this gravel <br />pit. <br />Thank you for your consideration. <br />Very truly yours, <br />Bradley K.
