Long <br />Division Dvecmr <br />Please find attached, Slurco Corporation's third request to extend the abatement <br />deadline beyond 90 days for NOV C-94-024. The subject violation was issued 9/29/94 <br />for maintenance issues at Sediment Pond 1. Three of the four abatement requirements <br />have been satisfied. The remaining requirement is to repair the erosion on the pond <br />embankment inslope that has been cut by wave action. Repair plans are to pull eroded <br />sediment back up onto the embankment inslope, regrade, line the inslope along the <br />waterline with geotextile fabric overlain with 4-inch diameter rock, and re-seed all areas <br />where vegetation is damaged by the repair operation. Slurco's request states that <br />inclement weather has resulted in muddy field conditions and water levels in the pond <br />remaining high enough to interfere with the repair plans. <br />Mr. Koblitz, Greystone, stated in a phone conversation with me today that on 7/14/95 <br />Mr. Byron Walker (engineer who conducts quarterly pond inspections) and Mr. Leon <br />Spalding were meeting with the contractor at the pond to stake out the job and finalize <br />details. Mr. Koblitz stated he expects the job to be completed by 8/15/95. <br />As the lead specialist for this mine, I can verify that inclement whether has persisted at <br />the mine site throughout spring and early summer. Muddy field conditions are especially <br />significant for this NOV because there are no roads leading to the pond, access is gained <br />only by crossing reclaimed areas. Rule 5.03.2(2)(c) lists climatic conditions as being one <br />of the five circumstances which may qualify a surface coal mine for extension of the <br />abatement deadline beyond 90 days. I recommend approval of the abatement deadline <br />to 9/24/95. <br />Summary of NOV C-94-024 on next page. <br />
