<br />Battle Mountain <br />NOPV Abatement <br />page 2 <br />Gold <br />Requirements <br />BMG will be permitted to operate the processing plant, includi g the <br />introduction of unprocessed ore, until the projected tailings ~uality has <br />been achieved. At that point in time BMG will cease operation of the <br />plant pending approval to recommence operation by the Division, <br />Monitoring of cyanide levels within the tailings slurry and li uid shall <br />continue to verify the anticipated decay of cyanide levels fol owing the <br />cessation of the detoxification program, until cessation is ap roved by <br />the Division. <br />The introduction of chemical compounds into the processing cirduit to <br />affect an immediate remedy of the tailings cyanide problem could <br />potentially create additional problems by amending the chemical <br />constituency of the tailings. The Division cautions BMG that i~t will be <br />held responsible for any unanticipated results of its remediallactions. <br />(5> Leak Detection System Effluent Containment: <br />In the event that fluid is intercepted by the tailings impound ent liner <br />leak detection system, BMG shall design and implement an autom ted system <br />to minimize the development of hydraulic back pressure within he leak <br />detection system. This system is intended to reduce the likeliIhood of <br />compromising the secondary clay liner by intercepting and withdrawing <br />leakage. <br />In the event that Cyanide is detected within the leak detection system ~i^-~° ^""`~ <br />effluent, BMG shall design and implement a containment system t return ~"`~' <br />all effluent to the tailings impoundment, in order to prevent i pact to <br />the environment. <br />(6) Cyanide Interception, Containment and Remedial Plan: <br />If the tailings area leak detection system yields more than the; approved <br />4.5 gallons/minute rate of flow, and Cyanide is detected within that <br />effluent, BMG shall evaluate all ground water monitoring data t <br />determine whether any cyanide contamination has occurred. Furt er, BMG <br />shall develop and submit an interception, containment and remed al plan <br />~ for impacted ground water, surface water and soil. This plan s all be <br />~ L~ submitted to the Division for review and approval within ten da s <br />~~~,,,,,,~` following detection of Cyanide in the leak detection system. <br />C5~' (7) Amendment of Ore Processing Methodology: <br />BMG's preliminary suspicions of altered metallic ore content, a¢d the <br />coincidental failure of the designed processing cyanide recover circuit, <br />are indications that the ore processing methodology currently b~ing <br />applied by BMG may require significant modification. If BMG determines <br />it necessary to modify its ore processing methodology, BMG shall submit <br />appropriate permit revision applications to the Division.
