Hayes Colorado Mined Land Reclamation Division 1313 Sherman Street, Room 215 Denver, CO 80203-2273 Re: Response to Mid-term Review Dear Matt: ll^~~M~~~~® OCT ?7 1989 MINED LAtvU RECLAMATION DIVISION Attached are revised pages 4-69, 4-70c, and 4-72b in response to questions Nos. 1 and 2, Hydrologic Balance section, of the Division's mid-term review. as committed to in West Elk Coal Company, Inc.'s (WECC) initial mid-term response letter dated August 15, 1989. In response to question No. 3, a list of the completion reports which should be contained in Exhibit 2.8.2.A.1 has been prepared. Attached are copies of the 1988 completion reports to update your copies of this Exhibit. All other reports listed should already be included in the Exhibit. WECC's response to the Division's species tliversity standard concern was submitted September 29, 1989. The following is a review of the stipulations listed in Appendix II of the mid- term review which were indicated to be "Active" or "Future" status. WECC's response to the stipulations and/or the location in the permit text where the stipulations have been incorporated are included. Stipulation 1. - This stipulation has been complied with. An adjudicated plan was submitted with technical revision No. 55 (B Seam) in Exhibit 4.9.A.1 , "West Elk Coal Company, Mt. Gunnison No. 1 Mine, Water Augmentation Plan" and as described in Section 4.9.A.8, page 4-72H. Stipulation 2. -The submittal of an Annual Hydrology Report (AHR) is committed to in Section 3.2.8.1, page 3-29, and Section 4.9.1, page 4-68, Section 4.92, page 4-70, and Section 4.9.3, page 4-71 have been revised to include the information required by this stipulation in the AHR. Stipulation 3. - WECC's plan for the construction of water tight seals in the case of toxic discharge is contained in Section 3.5.2, pages 3- 81 to 3-87 of the existing permit. ,:r.ico-eaa.
