You have requested that we provide <br />this response on behalf of southwestern to the comments of the <br />Office of the State Engineer {•SEON), dated October 3, 1994, <br />in connection with this reclamation permit amendment. Our <br />response is as follows: <br />1. InagplicabilitX of C R S fi 37-9U-137f111. <br />Tha SEO inoorrectly states that a gravel well permit must be <br />obtained by Southwestern. C.R.s, § 37-90-137(11) pnly requires <br />a well permit °in connection with the extraction oP sa ~ <br />rave by open mining.a (Emphasis supplied.) Soutbwestern's / <br />mining operation is a limestone mina. Consequently, the li <br />requirements of this statute for obtaining a well permit and <br />substitute supply plan are inapplicable to the Dowe Flats mine. <br />2. No Well Permit Rewired. Southwestern's mine <br />does not otherwise constitute a water °well" because it will <br />not be °used for the purpose or with the effect of obtaining <br />ground water for beneficial use from an aquifer.' ee C.R.S. <br />§ 37-90-103(21) and g 37-90-137(1). With the exception oP a <br />small wetlands area discussed below, Southwestern's amended <br />reclamation plan is to backfill the mine pits after mining, <br />so that ground water would not be permanently exposed after <br />reclamation. xoreover, during mining, Southwestern intends <br />to dewater any ground water intercepted in the pits and <br />disotLaxge Ruch water into the St. vrain Aiver or other natural <br />water course.
