-4- <br />In order for the Division to approve the surface water monitoring plan <br />described in the initial application on pages 780-109aaa and bbb, additional <br />clarification was required. The following stipulation was necessary for <br />permit approval and the requirement to submit an annual hydrologic report <br />remains in place. Therefore, the original stipulation has been modified to <br />the following: <br />Stipulation No. R1 <br />THE PERMITTEE IS REQUIRED TO SUBMIT TO THE DIVISION A YEARLY REPORT <br />ON THE PROGRESS OF HYDROLOGIC MONITORING WHICH INCLUDES ALL DATA <br />COLLECTED FOR THAT YEAR AND A DISCUSSION ON ANY CONCLUSIONS WHICH CAN <br />BE DRAWN FROM THE DATA. <br />The data submitted in Table 10 of the original permit application did not <br />support the conclusion that coal dust does not affect water quality in the <br />swamp adjacent to the tipple. In order to clarify this issue, the following <br />stipulation was necessary: <br />The applicant should re-analyze and resubmit the existing data in Table 10 to <br />consider the effects of coal dust on water quality in the adjacent swamp, or <br />alternatively the applicant should redesign the water monitoring program at <br />the tipple to collect usable data. This information should be submitted to <br />the Division no later than April 1, 1981. <br />This stipulation has been resolved. <br />Hydrologic data submitted during the previous permit term indicates that no <br />significant effects to the surface water hydrologic system have been <br />detected. This is primarily due to the reduction in coal production from <br />previously anticipated levels. <br />This section is in compliance with all applicable requirements, with continued <br />acceptance of the stipulations. <br />VI. Hydrologic Balance: Ground Water (2.04.5, 2.04.7, 2.,05.3(4) <br />Kerr Coal Company, in the original permit application, presented data <br />concerning the ground water hydrology of the mine area. <br />As part of the baseline hydrologic investigation, aquifer tests were performed <br />on the Sudduth Coal seam and its underburden. Aquifer testing of the <br />overburden was performed reported by Warren Hoffstra in a USGS Open File <br />Report entitled "Hydrology of the McCallum Study Area". <br />The Sudduth Coal seam had two pumping tests run, one on a faulted area near <br />Bush Draw and another on an unfaulted area. The permeability of the faulted <br />area was calculated to range between 16.5 gpd/f t2 and 25.4 gpd/f t2 to 4.0 <br />gpd /f t2. This permeability is sufficient to transmit and store water for <br />limited beneficial use, and can be expected to yield from 10 to 40 gallons per <br />minute. <br />
