y ..
3
August 23. 1996 Phone Message
I did receive a phone message from Mike Altavilla regarding the road work on Friday,
August 23. The message was delivered some time late in the afternoon. I heard the
message at approximately 4:45 P.M on Friday afternoon. I understood Mike to say that
Seneca had received approval from the county to do the road work. I did not understand
the message to say that road work had already begun. I saw no need to respond to the
message at that time.
August 26. 1996 Phone Conversation
I did call Mike Altavilla on August 26 to discuss the road work after you informed me that
Seneca had completed a 1000 foot long cut next to Road 27a which was 20 to 30 feet wide.
After I expressed some concerns, Mike asked if Seneca should stop working on the project.
I asked if the road cut was completed. He indicated the road cut was completed, and that
work was currently being done on the shoulder of Road 27. Since the widening of Road 27a
was complete, I told him I saw no point in a work stoppage. I did not say they should,
"continue with the widening", as indicated in Mr. Altavilla's September 4, 1996 letter to you.
During our conversation, I reminded Mike that during our August 19 inspection, you and
I had been told that work would begin during the third week of September. I asked why
work had already begun. Mike said that since Seneca was not hauling coal and had
equipment available at the time, and since the county road personnel had given their
approval, Seneca had begun the road cut on Road 27a on Friday, August 23.
c:\wp51\091296b
