y .. <br />3 <br />August 23. 1996 Phone Message <br />I did receive a phone message from Mike Altavilla regarding the road work on Friday, <br />August 23. The message was delivered some time late in the afternoon. I heard the <br />message at approximately 4:45 P.M on Friday afternoon. I understood Mike to say that <br />Seneca had received approval from the county to do the road work. I did not understand <br />the message to say that road work had already begun. I saw no need to respond to the <br />message at that time. <br />August 26. 1996 Phone Conversation <br />I did call Mike Altavilla on August 26 to discuss the road work after you informed me that <br />Seneca had completed a 1000 foot long cut next to Road 27a which was 20 to 30 feet wide. <br />After I expressed some concerns, Mike asked if Seneca should stop working on the project. <br />I asked if the road cut was completed. He indicated the road cut was completed, and that <br />work was currently being done on the shoulder of Road 27. Since the widening of Road 27a <br />was complete, I told him I saw no point in a work stoppage. I did not say they should, <br />"continue with the widening", as indicated in Mr. Altavilla's September 4, 1996 letter to you. <br />During our conversation, I reminded Mike that during our August 19 inspection, you and <br />I had been told that work would begin during the third week of September. I asked why <br />work had already begun. Mike said that since Seneca was not hauling coal and had <br />equipment available at the time, and since the county road personnel had given their <br />approval, Seneca had begun the road cut on Road 27a on Friday, August 23. <br />c:\wp51\091296b <br />
