O General Review Standards - Section 35.8 <br />a. The Variance of Use Permit that we are seeking is consistent with the long-range <br />master plans for E1 Paso County, and the E1 Paso County Land Development <br />Guidelines because it will apply to a wash plant in an existing permitted <br />aggregate pit situated in the Mineral Resources Master Plan area. <br />b. The wash plant is consistent with the intent and purposes of the A-3 and <br />A-4 zones because it is a necessary piece of ancillary equipment in an existing <br />permitted pit, whose function is to provide quality competitive aggregates <br />to the private and public economic sectors. <br />c. The wash plant, like most of our aggregate and asphalt production equipment, <br />will be in harmony with the character of the area, because it, too, shall <br />be hidden from public view because of the berms and landscaping previously <br />done. It is compatible with the existing and allowable land uses because <br />it will function in an existing permitted pit. <br />d. The wash plant shall not result in an overintensive use of land because <br />it will not enhance production, but rather improve the quality of aggregates <br />by removing unwanted sediments. <br />e. The level of public facilities and service shall be minimally increased <br />because the wash plant shall operate on a gasoline powered generator, and <br />the water shall come from our existing well. <br />O f. The addition of a wash plant will not create increased traffic or traffic <br />hazards in the surrounding area because it will not result in further production. <br />The present legal access shown on the plot plan is more than adequate for <br />the proposed use. <br />g. There will not be significant air, water, or noise pollution. The air pollution <br />will be mitigated through watering stockpiles and haul roads, as is presently <br />done. The water from the wash plant shall be circulated through two sediment <br />ponds, one of which will trap sediments, and the other which will catch <br />overflow water and recirculate it back through the plant. No run-off water <br />will be created. Noise pollution will be minimized because the washer runs <br />quieter than the existing asphalt plant and loaders which shall feed it. <br />h. The wash plant will not be detrimental to the public health, safety, or <br />welfare of present or future residents of El Paso County because it will <br />function within the guidelines of the State and County Health Departments, <br />Air Quality Divisions, MSHA, and it is a closed and protected area from <br />the public. <br />i. Like our MLRB and El Paso County permits require, the addition of a wash <br />plant shall conform with all applicable federal, state, and local laws or <br />regulations. <br />O <br />
