'~ <br />-3- <br />Notices of Violation <br />No. 80-41: <br />The spoil pile in question is comprised, in large part, of coarse river <br />cobble, gravel, and sandy soil. Due to the fact that unnecessary top- <br />soil loss could result from movin; the pile, stripping available topsoil, <br />then replacing the pile, we propose to simply remove the pile once and <br />for all. Tl,e spoil would be given to a local contractor and hauled from <br />the site. I would personally supervise the work to assure thaC topsoil <br />disturbance in the vicinity of tl~e pile was held to a minimum. I could <br />also provide "before, during, and after" photographic slides of the work <br />if you so desire. <br />Interim reclamation work would be timed as discussed on page 90 of Che <br />permit amendment application and seeded with the mixture shown on page <br />117 of the same document. <br />As we discussed during our Uecember 15, 1980, phone conversation, we will <br />await your response to this proposal before taking further action. If <br />you desire further information or have additional questions in regard to <br />this matter, please feel free to contact me. <br />No. 80-42: <br />Design plans pertaining to a sediment control pond at the truck dump site <br />are scheduled to be delivered to your office on Uecember 19, 1980, as you <br />have requested. We will await your approval before we begin construction. <br />No. 80-43: <br />As you requested daring our phone conversation on December 15, 1980, we are <br />submitting tl,e following tiinutable for use and final removal of the island <br />access fill material. <br />As was discussed, we have determined that the conveyor cannot be constructed <br />without gaining access for ;, crane over to the island. Rather than remov- <br />ing the fill maCCrial Cor the presenC, then possibly replacing it at a <br />later time, we propose to ]nave [lie material in place and complete the work <br />as quickly as possible, then remove the fill material in one step, thereby <br />reducing disturbance Co the stream bottom to a minimum. As we agreed, we <br />will await your cunsidcration of this proposal before taking further action. <br />The work that remains to be done consists of: 1. Construction of conveyor <br />support structures on either side of the Roaring Fork River, 2. Erection <br />of steel conveyor support structures, 3. Installation of enclosed conveyor <br />
