Provided conditions warrant, a <br />secondary haul road may be constructed just north of Section 13. <br />Finally, an irrigation ditch transgresses the southwest corner <br />moving from under County Road 44 to Mr. Roushar's property. <br />On the western boundary of the property, County Road 44 will not <br />be affected due to the proposed 30' setback of disturbed ,ground <br />from the property line. Furthermore, it is proposed that this <br />setback be used as a stockpile berm for overburden material which <br />will provide additional sound insulation from the pit. The <br />proposed setback will ensure that the telephone, water and <br />possible gas line buried along or below County Road 44 will not <br />be affected. The electric line that enters the property on the <br />southwest corner nearly parallels the current line of disturbance <br />in Phase I production. It has been assured that the mining <br />operations will not extend further to the west in Phase I, <br />therefore, this line will not be affected. However, the line <br />will need to be moved, or removed, when the proposed Phase V <br />production starts. In addition, the residence including the <br />house, barn, stockwater pond and the utilities (water, and <br />telephone) connecting from the northwest corner of the property <br />will need to be removed before Phase V mining starts. The <br />various fences transversing the property, except the property <br />line fences to the north, south, west and east due to the 30' <br />setback, will need to be removed as needed when the mining <br />extends into these areas. The construction equipment being <br />stored north of the current mining area needs to be removed. The <br />haul road and scale office located on the southwest corner of <br />current Phase I production will not be affected by further mining <br />operations. Provided the secondary haul road needs to be <br />constructed just north of section line 13 the utility lines <br />buried under or along County Road 44 should not be affected. The <br />electric line transgressing the property should be removed or <br />strung over the haul road if it is constructed. Lastly, the <br />irrigation ditch located on the southwest corner of Phase I <br />10 <br />
