Our initial review indicates that all preliminary items required by Rule 2.08.4(5) <br />have not been submitted. Thus your application is incomplete for purposes of filing as of March <br />12. 2004. <br />In accordance with Rule 2.07.3(1), you have the opportunity to amend, review, or otherwise <br />make your application complete. In order to call the revision complete, please address each of <br />the questions listed below. <br />Rule 2.05.4 Reclamation Plan <br />Rule 2.05.4(2)(a) requires a detailed timetable of each step of the reclamation plan. This <br />timetable should describe each step of the plan in detail and should relate directly to the <br />reclamation cost estimate in Section 3.0. With regard to the redistribution of topsoil, the <br />DMG finds the application deficient in the following areas. <br />The permit refers to subsoil and topsoil. No distinction is made as to the nature of <br />subsoil or its location at the site. The permit should clearly describe the plan for <br />removal of topsoil from specific stockpiles or borrow locations. These locations should <br />be identified on a map. Reclamation calculations should refer to each of these locations <br />and identify locations for re-application. Based on the fertilizer recommendations, <br />subareas of the disturbed area are described (i.e. Fill 9, Fill 8, saddle above Fill 8, etc.) <br />These subareas should be identified on the map also with regard to topsoil redistribution. <br />Volume information of topsoil in stockpiles and borrow areas should be sufficient to <br />ensure that all areas will achieve the .85 feet of topsoil material, if that is the proposed <br />plan. The permit should not refer to these proposed activities in the past sense, <br />although the DMG understands that some of the topsoiling work has been completed at <br />this time. Permit commitments such as chisel plowing prior to seeding should be <br />modified if LLC does not intend to conduct this task. Two revised pages were submitted, <br />2.05-35 and 2.05-59. Page 2.05-39 is titled Topsoil Recovery and Placement. Page <br />2.05-59 is titled Topsoil Redistribution.
