` NOV. 7.1996 5~50PM UN~ D COMPRNIES, . N0.252 P.3
Larry Oehler
Division of Minerals and Geology
November 7, 1996
Page 2
San Miguel County has bcen asked to agree for United to use the land over which their 30'
easement traverses. They apparently have no problem with our use of the land, as described is the
Mining and Reclamation Plans, however they Dave conditioned thew agreement upon United
agreeing to some issues that the County has presented to the Division is some commem lepers.
United Sad this approach to be inappropriate and unacceptable at this time. The easement that
San Miguel County has serves as an access to their gravel pit just east of the subject property that
lies in San Miguel County. This easement is anon-exclusive right-of--way that is partially shared
with United Companies. No excavation w~ occur on or across this easement. The easement will
remain as is, unobstructed and uninterrupted. It is hoped that further discussions will result is a
mutually acceptable ageement between San Miguel County end United by the time of the Board
hearing.
It is with optimism that we hope to have this easement issue resolved by the time of the Boazd
hearing, or within a reasonable time there after.
Sincerely,
UNITED COMPANIES
~~ ~'.
