<br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 118,
<br />Paragraph 3, of the Colorado Revised Statutes, that on June 3, 2005, an application to renew an existing permit to
<br />conduct coal mining operations at the Seneca II-W Mine was considered complete for the purposes of filing. All
<br />review and comment periods as provided in the Colorado Surface Mining Reclamation Act and the Rules initiate
<br />from this date of filing.
<br />Seneca Coal Company proposes to continue surface coal mining and/or reclamation operations on land located
<br />approximately 9 miles south of Hayden, Colorado. The permit area is further described as follows:
<br />TSN, R88 W; All of Section 15; Portions of Sections 9, 10, 11, ] 4, 16, 21, 22, 23, 26, 27, 34, and 35
<br />T6N, R88W; Portions of Sections 14, 23 and 24
<br />T6N, R87W; Portions of Sections 17, 18, 19
<br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle maps of Hayden Gulch, Hayden,
<br />Dunckley, Mt. Harris.
<br />This permit renewal application would allow for renewal of Permit C-1982-057 for a new five year permit term,
<br />which would extend to December 31, 2010. The application does not propose any expansion of approved permit
<br />boundaries or surface disturbance acreage, nor does it propose any changes to approved mining or reclamation
<br />plans.
<br />in accordance with the May 1991 Memorandum of Understanding (MOU) between our agencies, we must have
<br />your concurrence in order to approve this proposal. We are required to make a finding that "the proposed
<br />operations will not adversely affect any publicly owned pazk or place listed on or those places eligible for listing,
<br />as determined by the SHPO, on the National Register of Historic Places, unless approved jointly by the Board and
<br />the Federal, State, or local agency with jurisdiction over the park or place." Therefore, we request that you submit
<br />comments regarding your concurrence with, concerns with, or objections to this proposal. In order that we may
<br />comply with regulatory time frames, we request that comments be submitted within thirty (30) days of this letter.
