Mr. Dar Mathews <br />Division of Minerak and Geohgy <br />Page 2 <br />There is another situation that could potentially affect the timing and SCC's ability to maintain the <br />schedule for contemporaneous xec]amation......The IJMWA labor contract egpixes September 1, <br />2005. There is a potential fox a work stoppage, however, the past two (2) UMWA contracts have <br />been successfully ratified without interruption to the operation. In SCC's case the LTMWA members <br />at Peabody Western's Arizona operations outnumber the SCC union members and will probably <br />have the controlling votes is the decision. If a strike occurs, then SCC's ability to meet the <br />reclamation schedules will be severely hampered.
