DAVID REED AUG 31 1994 <br />C:vision or nureras n G°o;agy <br />ON SATURDAY AFTERNOON, AUGUST 27, 1994 AT APPROXIMATELY 5:00 PM <br />I RECEIVED A TELEPHONE CALL FROM DEPUTY WARREN WATERMAN WHO <br />INFORMED ME THAT THE GATE TO THE MICHAEL GUFFEY PROPERTY LOCATED <br />APPROXIMATELY 9 MILES SOUTH OF MONTROSE, COLORADO WAS OPEN AND A <br />PICKUP TRUCK BELONGING TO TOMMY WATSON WAS PARKED INSIDE THE <br />PROPERTY. I IMMEDIATELY CONTACTED THE NEIGHBOR, MRS. EDDIE BABBITT TO <br />INQUIRE IF SHE KNEW ANYTHING ABOUT IT. SHE CONFIRMED THAT MR. WATSON <br />HAD BEEN ON THE GUFFEY PROPERTY THAT DAY MOVING DIRT AROUND. SHE <br />INDICATED THAT HER HUSBAND HAD GONE OVER TO MR. WATSON AND ASKED <br />HIM TO LEAVE THE PROPERTY BUT THAT MR. WATSON IGNORED MR. BABBITT'S <br />REQUEST. <br />I THEN DROVE T O TF~E PRGFERT'~'. AS i APPROACHED THE PROPERTY I SAIN <br />A WHITE TRACTOR ENTER THE PROPERTY AND DRIVE DOWN TO THE MILL SITE. <br />I OBSERVED MR. WATSON GET OUT OF THE TRACTOR. I THEN CALLED DEPUTY <br />WATERMAN AND ADVISED HIM THAT I HAD OBSERVED MR. WATSON ON THE <br />PROPERTY. I ASKED HIM TO REMAIN ON THE LINE OF MY CELLULAR PHONE <br />WHILE I CONFRONTED MR. WATSON WHICH HE AGREED TO DO. I THEN ENTERED <br />THE PROPERTY AND APPROACHED MR. WATSON WHILE I REMAINED IN MY <br />VEHICLE. I PULLED MY VEHICLE TO WITHIN ABOUT FIVE FEET OF MR. WATSON <br />AT WHICH TIME I OBSERVED THAT THE TRACTOR WAS STILL RUNNING WITH ONE <br />PERSON IN IT. I THEN ASKED MR. WATSON WHAT HE WAS DOING ON THE <br />PROPERTY. HE TOLD ME THAT HE WAS DOING THE RECLAMATION WORK <br />ORDERED BY THE MINED LAND RECLAMATION DIVISION. I TOLD HIM THAT HE <br />WAS NOT AUTHORIZED TO BE ON THE PROPERTY UNTIL SUCH TIME AS THE <br />DETAILS OF THE RECLAMATION WORK HAD BEEN AP?ROVED THROUGH MY OFFICE. <br />HE STATED THAT HE DID NOT NEED AAR. GUFFEY'S PERMISSION TO BE ON THE <br />PROPERTY IN LIGHT OF THE ORDER OF THE MINED LAND RECLAMATION DIVISION. <br />I ADVISED HIM THAT UNTIL SUCH TIME AS HE HAD SPECIFIC PERMISSION TO BE <br />ON THE PROPERTY HE WAS CONSIDERED A TRESPASSER. I ADVISED HIM THAT <br />I HAD A SHERIFF'S DEPUTY ON THE TELEPHONE AND THAT IF HE FAILED TO <br />REMOVE HIMSELF IMMEDIATELY I WOULD ASK THE SHERIFF'S DEPARTMENT TO FILE <br />TRESPASS CHARGES. AT THIS TIME THE TRACTOR WITH THE OTHER INDIVIDUAL <br />INSIDE DROVE AWAY. I THEN ASKED HIM IF :-iE Vu'AS STILL RF.PR^SENTED BY <br />FRANK WOODROW. HE ADVISED ME THAT HE WAS AND BEGAN TO ARGUE WITH <br />ME ABOUT THE HEARING, THAT IT WAS COSTING HIM 5400 PER DAY UNTIL HE <br />COMPLETED THE RECLAMATION WORK, THAT HE HAD PERMISSION TO BE THERE, <br />THAT IF THERE WERE ANY INSURANCE OR OTHER REQUIREMENTS THEY SHOULD <br />HAVE BEEN BROUGHT UP AT THE HEARING AND THAT I BETTER GET OUT OF HIS <br />WAY IF WE WANTED THE RECLAMATION WORK DONE. I TOLD HIM THAT I COULD <br />NOT DISCUSS THIS MATTER WITH HIM SINCE HE WAS STILL REPRESENTED BY MR. <br />WOODROW. I AGAIN ASKED HIM TO LEAVE THE PROPERTY. I TOLD HIM THAT <br />I WOULD BE HAPPY TO MEET WITH HE AND HIS ATTQRNEY ON MONDAY MORNING <br />TO WORK OUT THE DETAILS OF HIS GAINING ACCESS TO THE PROPERTY FOR THE <br />RECLAMATION WORK. I ALSO ASKED HIM TO CALL MR. WOODROW ON <br />SATURDAY NIGHT AND THAT MR. WOODROW COULD CALL ME THAT EVENING IF <br />HE WANTED TO DISCUSS THIS MATTER. I THEN LEFT THE PROPERTY AND <br />
