Box 2G <br />Del Norte, CO 81132 <br />Secs. 25, 29 and 30, R3E; Sec. 25, R4E, T3N, N.M.P.M., Rio Grande <br />County, 1,231 acres; 112 open pit mine and cyanide heap leach facility. <br />Consideration of amendment to Compliance Plan. <br />Mr. Frank Johnson, Assistant Attorney General, clarified that this <br />matter is a continuation of the hearing conducted regarding 3 NOVs <br />issued to the operator in Auqust. He distributed ATTACHMENT D - a <br />proposed amendment to the Settlement Agreement, including a Compliance <br />Plan which has been incorporated into a Board Order. A provision of <br />the Board Order was that any changes to the compliance schedule had to <br />be in writing, signed by the various parties to the Settlement <br />Agreement and approved by the Board. <br />The Compliance Plan required SCMCI to cease all land application of <br />treated waste water by October 30, 1991. Under the terms of the <br />Compliance Plan, SCMCI can only discharge from the heap by direct <br />discharge from the treatment plant. <br />Mr. Johnson stated that SCMCI has experienced problems with the <br />treatment plant which has caused a requirement for additional <br />modifications. He said SCMCI has stated that because the plant needs <br />to be tested, they may require leniency on effluent limitations <br />contained in their CPDS permit from the Health Department. Mr. Johnson <br />said he felt the parties could agree on a protocol and monitor the <br />situation closely (4 to 6 weeks). Therefore, the Division will agree <br />to extensions to allow testing of the treatment plant. <br />Mr. Dean Massey, an attorney representing SCMCI, said that extensive <br />modifications which had to be made at the site may cause the need f~i~ <br />flexibility in the Compliance Schedul?.
