I <br />i <br />It was MOVED that the Board direct the operator to amend the current: <br />permit application in order to address the 3 concerns of~the Board. <br />SECONDED. Second withdrawn; no vote taken. <br />i <br />During further discussion, it was the Board's consensus that it could <br />not require the operator to amend the permit. They said!the company <br />should work with Conejos County to resolve conflicts that are not under <br />this Board's jurisdiction. ~ <br />In response to concerns of the Board regarding reclamation planned for <br />this site, Staff said the operator's seed mix was prepared by the local <br />Soil Conservation District, and the bond posted by the operator is the <br />highest required by law. ~ <br />It was MOVED that the Board deny the appeal of the Division's decision <br />to issue a permit in this matter. Monthly status update (continued from the October 1991 <br />Board Meeting). <br />Staff discussed the Settlement Agreement approved by the Board on June <br />26, 1990, which was issued to: 1) address reclamation of Pit 4 at the <br />site and 2) expedite a partial bond reduction for work completed at the <br />site in anticipation of bond forfeiture. <br />Staff referenced slides of the site and said the eperatorl reestablishzd <br />the original topography at Pit 4 in accordance with the ~?ttlem?rt <br />Agreement. By the end of the summer (of 1991) the operator had <br />established a very good stand of vegetation, with grasszs~ a fe~:~ feet <br />deep. Staff said the a smal l section of the site ~.~as o•rerlco' ?d :~I,l i? <br />regrading and backfilling was being completed. At this time, the <br />Division is working with the operator to Correct the oversight. On <br />October 16, 1991, the operator submitted a plan for resolution of the <br />problem. The Division is in the process of reviewing that plan. <br /> <br />Staff said the current Settlement Agreement, which is due to expire at <br />the end of November 1991, will be extended for an adequate period of <br />time to complete the work at the site.
