Rule 2.05.6(61: The existing permit application states on page 534 that subsidence will <br />occur over the undermined area. <br />(a) Per 2.05.616)(a-, please provide an inventory of all structures existing within the <br />permit and adjacent areas, including the sediment pond, the permanent stream <br />channel diversion, its associated culverts, the refuse pile, all backfilled portals, and all <br />structures proposed to remain following reclamation; <br />(b) Per 2.05.6(6)(a)(ii)(A-, please provide a description of each of these structures; <br />(c) Per 2.05.6(6)(a)(ii)(B), please provide a structure inventory map prepared pursuant to <br />Rule 2.10 that identifies the location and configuration of these structures; <br />(dl Per 2.05.6(6)(b)(il, please provide a description of the worst possible consequences <br />which subsidence would have upon these structures. Please include in this descrip- <br />tion adetermination of whether subsidence will cause material damage to, or diminu- <br />tion of reasonably foreseeable use of, these structures (definitions of material <br />subsidence damage to, and diminution of reasonably foreseeable use of, structures <br />may be found in Rule 2.05.6(6)(e)(ii)(A- and IC)). Please also provide a brief descrip- <br />tion of subsidence-related phenomena predicted within the permit and adjacent areas <br />(2.05.6(6)(b)(i)(B)1. <br />(e1 If the description of worst possible subsidence consequences determines that no <br />material damage to, or diminution of reasonable foreseeable use of, the structures <br />within the permit and adjacent areas will occur, and the Division concurs with that <br />determination, then, pursuant to Rule 2.05.6(6)Ib)(ii), asubsidence monitoring <br />program, as described in 2.05.6(6)(c) and designed to determine the accuracy of that <br />conclusion, will need to be prepared. <br />(f) If the description of worst possible subsidence consequences determines that no <br />material damage to, or diminution of reasonable foreseeable use of, the structures <br />within the permit and adjacent areas will occur, but the Division does not concur with <br />that determination, or if the description of worst possible subsidence consequences <br />determines that either material subsidence damage to, or diminution of reasonably <br />foreseeable use of, any of the structures will occur, then, pursuant to 2.05.6(61(b)(iii), <br />either a subsidence survey (described in 2.05.616)(e)), or a subsidence control plan <br />(described in 2.05.6(6)(f)) will need to be prepared. <br />15. Rule 4.03: Please describe whether any new roads are planned as a result of this TR. If <br />any new roads are to be constructed, please describe the types and locations of these <br />roads. <br />16: Rule 4.05.1(4-(b)(iv) and (v): Please discuss whether the watershed diversion ditches <br />above the refuse pile are planned for removal or for permanent retention. If they are <br />planned for removal, then the drainages above the refuse pile will be conveying their runoff <br />
