Please add any structures that are not currently in this narrative that <br />exist at the mine site presently or that are planned to be added. <br />5. Rule 2.05.3(41(a): As the mine sediment pond is proposed to be modified, please provide <br />both the general plan and designed plan for this modified pond, in accordance with <br />2.05.3(4)(a)(i) and (ii). <br />6. Rule 2.05.3(4)(b): As part of the response to Item 5 of this letter, please demonstrate that <br />the modified pond designs are in conformance with all applicable portions of 4.05.6 and <br />4.05.9. Please also provide the demonstrations required pursuant to 4.05.9 for permanent <br />pond retention. <br />7. Rule 2.05.3(8): No materials were submitted with this TR updating this section of the <br />permit application. Rule 2.05.3(8)(a) requires both a general plan and a detailed design <br />plan for coal mine waste banks, as well as a narrative explaining the construction, <br />modification, and reclamation of the waste bank. Please provide responses that address <br />each applicable section of 2.05.3(8)(a-(i) and (ii). <br />8. Rule 2.05.4(2)(c-: Please provide a discussion of how soils replaced during reclamation <br />will be stabilized from wind and water erosion. Methods of soil stabilization include <br />contour terraces, berms and ditches. <br />Map 17, "Post Mining Topography," indicates a 7.3-acre flat area on the top of the refuse <br />pile between the post-mining elevations of 6500 and 6505. However, Figures 17-1 and <br />17-2 show a different post-mining topography. Please address this discrepancy. <br />9. Rule 2.05.5(2)(a)(i): Please describe whether any support activities will be necessary to <br />achieve the final use of Rangeland. <br />10. Rule 2.05.5{2){d): Several structures are proposed to remain fallowing reclamation. <br />Please provide "a clear demonstration along with supporting information that the pre-- <br />mining land use capability will be achieved" even though those structures will remain. <br />11. Rule 2.05.6(3)(a)(ii-: Please describe whether leaving the sediment pond as a permanent <br />structure adversely affects the rights of present downstream users of surface water. <br />12. Rule 2.05.6(31(al(iii): If downstream surface water users will be adversely affected by the <br />retention of the sediment pond as a permanent structure, describe whether a plan for <br />providing alternative sources of water will be developed in accordance with <br />Rules 2.04.7(3) and 4.05.15. <br />13. Rule 2.05.6(3)(b)(i): Please provide designs and cross sections for the reconstructed <br />drainage that appears will exist in the northeast area of the refuse pile. Please discuss <br />whether the upland diversions currently in place above the refuse pile are proposed to be <br />altered by this TR. <br />
