Mr. Randy Spencer Ms. Susan Mowry August 1, 1985 PART II - ADVISORY COMMENTS Page Eight Bear Coal Company stated that they would continue using appropriate procedures for alluvial well sampling, (i.e. refrigeration and proper filtering of the water samples) Bear Coal Company has designated a yearly submittal date of March 1, to submit monitoring data in accordance with stipulations No. 5 and No. 6. PART III - STIPULATION STATUS Bear Coal Company agreed to complete the Flood Control Plan in accordance with stipulation No. 2 and to have it certified. Bear Coal Company agreed to proctor testing of the Bear No. 1 portal backfill and to submit these results in accordance with stipulation No. 9. PART IV - RECLAMATION BOND Bear Coal Company agreed to recalculate and submit a reclamation bond estimate by September 1, 1985, to the Division. Review of the reclamation bond will occur in two (2) steps in that pending clarification of areas of responsibility at Bear No. 1 and No. 2 Mines, the Bear Coal Company bond requirements may be reduced. In addition to the items pointed out in the mid-term review letter, Susan Mowry of MLRD pointed out that the post-mining topo map was not sufficient in the permit. Bear Coal Company agreed to review existing data and to make any changes that were necessary. Submittal times for the reorganization of the permit and other required information were discussed. Bear Coal Company stated that it would take until August 15th, to have the survey of Bear No. 1, No. 2, and Bear No. 3 area completed and that this was needed to accurately recalculate the reclamation bond. It was agreed by both Bear Coal Company and the Division that the submittal date for the Reclamation Bond would be September 1, 1985. The submittal date for the reorganization of the permit as well as other required information in the mid-term review would be September 15, 1985.
