Cumulative impacts were identified from the future expansion of this mining action. These <br />impacts are all the result of mining on the State land and from developments on the surrounding <br />private lands. Because BLM has no jurisdictional authority over actions on State and private <br />lands, the Bureau can do nothing to alleviate these impacts. Likewise, suggestions that BLM <br />monitor activities on State and private lands can also not be implemented because of [he lack of <br />jurisdictional authority. If BLM were to deny new contracts for mineral materials on the Federal <br />mineral estate, i[ could hasten the onset of the cumulative impacts due to the more rapid increase <br />in mining on State lands. <br />BLM continues to have concerns about the Mexican spotted owls that are found north of the <br />State section on public lands and will continue to work with the Fish & Wildlife Service in their <br />efforts to monitor impacts to these birds. It is our understanding that a Habitat Conservation Plan <br />(HCP) is being prepared by the operators for the quarry activity. We believe it is the <br />responsibility of FWS to insure that adequate monitoring of the species and it's habitat is <br />included in the HCP and that these activities aze implemented. <br />The impacts to [he Federal mineral estate will be alleviated upon completion of the mining on <br />that parcel, some 10 or more years in the future. At that time a CDMG approved reclamation <br />plan will be implemented. This will eventually bring the land back to meeting the Standards for <br />Public Land Health. <br />Within 30 days of receipt of this decision, you have the right of appeal to the Board of Land <br />Appeals, Office of the Secretary, in accordance with the regulations at 43 CFR 4.400.
