., <br />r <br />-2- <br />NOTICE OF VIOLATION <br />Rased upon these same Findings of Fact and in accordance with <br />C.R.S. 34-32-124(6), the Colorado Mined Land Reclamation Board hereby finds <br />David Bacon and Glenn Southwick to be in violation of Permit M-86-007, <br />specifically condition 2 on page 2, and C.R.S. 34-32-110(4). <br />CEASE AND DESIST ORDER <br />Based upon these same Findings of Fact and Notice of Violation, and in <br />accordance with C.R.S. 34-32-124(2),(6) and (7) the Colorado Mined Land <br />Reclamation Board hereby orders David Bacon and Glenn Southwick to: <br />1. Cease and desist from conducting any and all mining operations at the <br />"Masonville Stone" mining operation - Permit M-86-007. <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined Land <br />Reclamation Board, written notice of your compliance with paragraph one (1) of <br />this Cease and Desist Order. <br />3. Complete the following corrective action: <br />Submit the E50.00 annual fee and notice of intent to continue mining <br />(annual report) for 1987 to the Mined Land Reclamation Division by no <br />later than June 19, 1987. <br />4. Pay the Colorado Mined Land Reclamation Board a civil penalty in the <br />amount of 5200.00, by no later than June 19, 1987. This is based upon an <br />assessment of E200.00 per day for one (1) day of violation, March 11, 1987. <br />This Cease and Desist Order shall remain in effect until all terms have been <br />satisfied by the operator. <br />
