., <br />STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF: <br />David Bacon and Glenn Southwick <br />NOTICE OF VIOLATION M-87-032 <br />AND <br />CEASE AND DESIST ORDER <br />T0: David Bacon and Glenn Southwick and all other persons engaged in or <br />owning or controlling the following operation: "Masonville Stone" <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by C.R.S. 34-32-124, the Board hereby makes the following <br />findings of fact: <br />1. David Bacon and Glenn Southwick is permitted to conduct a mining operation <br />under the terms of Permit M-86-007 located in NW 1/4 SW 1/4, Section 26, <br />Township 6 North, Range 70 West of the 6th P.M., in Larimer County, Colorado. <br />2. The Mined Land Reclamation Board conducted a Formal Public Hearing on May <br />27, 1987 to consider possible violation of the terms of Permit M-86-007 and <br />C.R.S. 34-32-101 et seq. <br />3. The Mined Land Reclamation Division presented evidence at the Formal <br />Public Hearing on May 27, 1987, demonstrating that: <br />A. The E50.00 annual fee and notice of intent to continue mining <br />(annual report) for 1987 for permit no. M-86-007 were due by no later <br />than March 11, 1987. <br />B. To date, these items have not been submitted to the Mined Land <br />Reclamation Division. <br />
