RULE 8: INSPECTIONS , MONITO OG, ENFORCEMENT AND BOND FORFEI1QE <br /> 121 8. 1 Inspection and Monitoring <br /> 8. 11 (1 ) Entry upon lands for inspection : the Board , the Division <br /> ® of Mines of the State of Colorado, the chief inspector of <br /> coal mines , or their authorized representatives may enter <br /> upon the lands of the operator at all reasonable times for <br /> the purpose of inspection to determine whether the provisions <br /> of this article have been complied with. <br /> (2) Persons authorized under this article to conduct inspections <br /> shall , prior to entry onto any lands , notify the operator <br /> of their intent to enter and inspectors shall comply with <br /> all federal , state, local and company safety rules. <br /> 8. 12 Any state official or employee associated with the Mined Land <br /> Reclamation Division shall Dromptly report to the Board any <br /> possible violation of a permit , law or these Rules of which he <br /> has knowledge, whether obtained from personal inspection or <br /> from written reports on mining operations. <br /> 8. 13 Upon receipt of notice of oossihle violation(s) the Board <br /> shall determine whether the operator should be cited or further <br /> investigation is required. <br /> 8. 14 All inspections shall include a written report, which: <br /> (1) Describes every possible violation of the permit , law, or <br /> these Rules; <br /> (2) Is personally signed by the inspector : and <br /> ® (3) Within ten (10) days is mailed to or filed at : <br /> (a) The Mined Land Reclamation Division ; and <br /> (b) The mine office, or other suitable location designated <br /> by the operator. <br /> 8. 15 A report of how and when a violation is resolved and a report of <br /> any subsequent inspection to verify compliance shall be filed as <br /> required in Section 8. 13. <br /> 8. 16 All operations applying for a regular permit , conversion , or <br /> amendment thereto shall be inspected after the application is. <br /> filed and prior to Board consideration. Other applicants shall <br /> be so inspected as time and staff resources permit. <br /> 8. 17 MininD operations shall be inspected a sufficient number of <br /> times each year to insure compliance with the permit , law, and <br /> these Rules. <br /> The frequency of inspection shall be determined by the extent <br /> of the operation, rate of mining , degree of actual or potential <br /> environmental impact , and the operator's past record of com- <br /> pliance. <br /> - 43 - <br />
