117(2) 7. 17 The tyfland/or amount of surety may be0justed by the Board <br /> from time to time due to changed economic conditions or as sig- <br /> nificant stages of the reclamation plan are completed or amended. <br /> 117(3) 7. 18 A surety may only cancel its obligations by providing notice of <br /> cancellation to the Board at least sixty (60) days prior to the <br /> anniversary date of the bond and of its intent to limit its <br /> exposure to existing circumstances as of that anniversary date. <br /> 117(3) 7. 19 Within thirty (30) days after receipt of notice of cancellation <br /> as described in Section 7. 18, the operator shall provide adequate <br /> substitute surety covering operations or post cash surety in <br /> lieu thereof which substitute surety shall be made effective as <br /> of the cancellation date of the prior surety, <br /> -OR- <br /> within sixty (60) days of notice from the Board of the suspension <br /> or revocation of the corporate surety' s license to do business in <br /> the State of Colorado. <br /> 7.2 Surety Release <br /> 117(6) 7.21 (1 ) An operator under a regular, limited impact or special <br /> permit may file a written request for: <br /> (a) Release of his total surety as to all affected lands <br /> when reclamation has been completed, or <br /> (b) Reduction of his surety as to any significant segment <br /> of the affected lands , <br /> ( i ) when reclamation has been completed, or <br /> (ii ) when a significant physical stage of the <br /> reclamation has been completed. <br /> (2) The Board shall conduct as soon as possible but not later <br /> than sixty (60) days from receipt of written request , an <br /> inspection and evaluation of the reclamation and determine <br /> whether it meets the requirements of the reclamation <br /> plan, the law, and these rules. <br /> 110(5) (3) After determination that the requirements of the reclama- <br /> 111 (5) tion plan, the law, and these rules have been met , the Board, <br /> within thirty (30) days after such determination, shall <br /> release the surety or applicable portion thereof. <br /> 113(5) 7.22" (1 ) A prospector shall file a written notice upon completion <br /> of all prospecting operations described in the applicable <br /> Notice of Intent to Conduct Prospecting. <br /> 113(5) (2) Vithin ninety (90) days after such filing, the Board shall <br /> notify the prospector of the steps necessary to reclaim the <br /> land in accordance with RULE 6. <br /> �.1 <br /> - 41 - <br />
