510(8NO 3.22 The Orator shall : •
1120 0) (a) (1 ) Upon filing the application , place for public review a
copy of the application less confidential items , with
the clerk or recorder of the county or counties in which
the affected land is located. e
112(10) (b) (2) Within ten (10) days after filing, publish notice in a
newspaper of general circulation in the locality of the
proposed mininq operation twice, one week apart, containino:
a. Name and address of applicant ,
b. Location of the proposed mining operation by section ,
township and range and street address , where applicable,
c. Proposed dates of commencement and completion of the
operation,
d. Proposed future use of affected land,
e. Location where additional information on the operation
may be obtained,
f. Location and final date for filing objections with the
Board, and
g. Date, time and place set for consideration by the Board ,
if known.
1120 0) (c) (3) Immediately after the first publication, mail or personally
serve a copy thereof to :
a. All owners of record of surface ria_ hts to the affected
land, and
b. All owners of record of surface rights to the imme-
diately adjacent lands.
112 0 0) (c) (4) As soon as designated by the Board, mail a copy thereof to
any other owners of record who might he affected by the pro-
posed minion operation. The Board shall designate such
owners , if any , within one week after the filing of the
application.
112 0 0) (c) (5) Prior to Board consideration of the application , submit
proof of publication , mailing or personal service of all
required notices by certified mail with return receipt
requested where possible.
1150 ) 3.23 The Board shall give written notice of the date, time and place
set for consideration of the application , which shall not be
more than thirty (30) days after filing, to:
a. The operator, by mail ,
b. Any county in which the proposed mining operation is to be
located, by mail , and
c. Any municipality within two (2) miles of the proposed mining
operation, by mail .
(Notice to the public regarding the application will be given
as provided in Section 1 .26. )
