<br />II. ISSUES TO BE CONSIDERED <br />1. Presentations to the Board shall be strictly limited <br />to the issue of whether the application for the amendment of Bat- <br />tle Mountain's permit complies with the requirements of the Colo- <br />rado Mined Land Reclamation Act and the regulations promulgated <br />by the Board. The Board will not consider any issue relating to <br />the validity of the underlying permit, nor may the parties <br />present any evidence on such issues. Furthermore, the parties <br />opposing the amendment shall restrict their presentaticns to <br />those issues addressed in their respective statements requesting <br />party status. <br />2. Parties opposing the amendment shall be restricted to <br />presenting evidence on the following issues: <br />a. Project design, including: <br />1) Waste rock, tailings and pond management; <br />2) Hydrological controls; <br />3) Hazardous materials handling an9 storage. <br />b. Water quantity. <br />c. Emergency Response Plan <br />d. Financial warranty. <br />e. Revegetation. <br />f. Geochemistry of waste rock. <br />For these latter two issues, presentations shall be <br />limited to environmental consequences associated with new loca- <br />tions and modified geochemistry of the waste rock and Mailings <br />piles. Amore comprehensive listing of particular conccerns which <br />might be raised under the design issue is appended to this pro- <br />posed prehearing order. <br />III.
