Alpine Rock will pursue legalizing topsoil import with a Notice pursuant to Construction Materials Rule 3.1,9(5), as administered by the DRMS. 4. Upon DRMS issuance .of formal approval of a Succession of Operator of Reclamation Pernut to Owners, or, upon DRMS's issuance to Alpine Rock of a formal approval and acceptance of satisfactory completion of all Reclamation Permit required site reclamation activiiaes, whichever occurs first, Alpine Rock shall pay the Owners the amount of the $34,339.00 in consideration of Owners ]laving relieved Alpine Rock of its reclamation responsibilities pursuant to Reclamation Permit M-1993-035. C. Other Provisions. The following documents are attached hereto and hereby incorporated into this Agreement by this reference: a. DRMS letter dated April 16, 2007 regarding the Reclamation Permit. b. The Reclamation Permit. 2. Nothing in this Agreement should be construed to interfere with the pzoper administration of the Reclamation Permit. 3. Notice.
