<br />does not contain adequate designs nor a demonstration that the State and Federal effluent <br />limitations will be met. This violation was cited by MLRD in NOV C-91-006 issued <br />6/18/91. <br />The permittee has not seeded and mulched the reclaimed areas during the first favorable <br />seeding season. This violation was cited by MLRD in NOV C-91-005 dated 6/18/91. <br />The approved reclamation configuration of the Cameo Seam development rock fill is in <br />violation of Rule 4.14.1 (2) (a). This rule requires that all available spoil material be <br />utilized to eliminate all highwalls and depressions and return all disturbed areas to <br />their approximate original contour. The Cameo Seam Portal, bench, and development rock <br />fill were utilized to facilitate mining during the interim program as evidenced by the <br />attached OSM inspection reports dated 5/9/79; 2/6/80; and 8/26 6 27/80 ( attached ). <br />Although the landowner requested that the access road and Cameo Seam Portal bench be left <br />as post-mining features, post-mining land use changes do not preclude compliance with the <br />rule cited. Therefore, this violation is being cited in Ten-Day Notice (TDN) 91-2-116-5. <br />Correspondence provided by MLRD dated 9/7/90 documents a proposed bond reduction from $ <br />141,000 to $ 90,000 which was subsequently approved. MLRD internal correspondence dated <br />2,20,90 and 7,2,90 also document the bond reduction. These documents indicate that part <br />of the justification for the bond reduction included reduced liability for reclamation <br />performed. The reclamation performed included the Cameo Seam Portal bench described above <br />and presumably the structural demolition noted in the MLRD 7/2/90 internal <br />correspondence. The reclamation performed on the Cameo Seam Portal Area does not comply <br />with the approved Colorado program as noted above and, therefore, was not an appropriate <br />justification for bond reduction or bond release. This violation is included in TDN 91-2- <br />116-5. <br />Additional correspondence provided by MLRD included the current liability insurance <br />certificate; bond calculation forms and calculations; and the MLRD inspection report/ <br />NOV's issued during this inspection.
