<br />Accompanied Randy Price of the Colorado Mined Land Reclamation Division ( MLRD ) on a <br />random sample oversight inspection of the Fruita 11 1 and 2 Mines on 6/4/91. Weather <br />conditions were clear and warm with only minor evidence of surface water runoff <br />throughout the minesite. All areas inspected were video taped during the inspection. This <br />inspection report and Ten-Day Notice issuance has been delayed due to the need for <br />additional information collection and documentation concerning the approved Reclamation <br />Permit, hydrological monitoring, sediment pond inspection reports, liability insurance, <br />and historical development of the Cameo Bench Portals and associated disturbance. <br />MLRD Notice of Violation C-90-030 which was issued 7/26/90 for failure to implement the <br />approved reclamation plan was terminated 1/18/g~ after a MLRD inspection determined that <br />the reclamation plan had been implemented as approved. MLRD also conducted a Phase I bond <br />release inspection on 2/28/91 to further evaluate the completed backfilling and grading <br />work. The approved reclamation plan was processed as a revision to the expired interim <br />permit No. 79-60 UG/C. The permanent program permit application, No. C-81-015, was never <br />approved. <br />Completed backfilling and grading operations observed during this tnspection_included: <br />regrading/covering/topsoiling of the former coal stockpile area and the Anchor Seam lower <br />bench coal processing and coal stockpile pad including reestablished drainages through <br />these areas; AOC regrading/topsoiling of the upper Anchor Seam bench and access road; <br />regrading and ditch reestablishment on the Cameo Seam bench road; the development rock <br />fill at the Cameo Seam bench was graded to 2:1 with soil like material graded on the <br />slope and a permanent diversion established above the fill; no additional reclamation was <br />done on the Cameo Portal bench or highwalls; and the eastern sediment pond was <br />eliminated, regraded and topsoiled, and disturbed areas draining through this location <br />were approved under a small area exemption ( SAE ). <br />The approved SAE is actually an alternate sediment control area (ASCA) as a series of <br />straw bale dikes facilitate surface water runoff control for this area.
