<br />ORIGINAL TR-07 QUESTIONS <br />On proposed revised page 2.04-33, it is stated that the Iron Point Gulch is either an <br />intermittent or a perennial stream. The 1997 Annual Hydrolabic Report shows that <br />station Dad-I2, at the outlet of the Iron Point Gulch, had a flow of A02 cfs on Octaher <br />31, 1997. If a conclusion can be made using this data and store recently acquired <br />hvdrolagic data, please update this stream classification. <br />The Division has no further concerns. BRI. has stated on revised page 2.04-33 of the <br />submittal dated May 12, 1999 that Iron Poin[ Guich is an intermittent stream. <br />9. A discussion of the impact of mine water discharge and refuse pile leachate on the North <br />Fork of the Gumtison is presented on proposed revised pages 2.05-74 and 2.05-75. <br />Please add a discussion of the impacts to users of the water after it leaves the Borvie No. <br />Z Mine site btit before it reaches the North Fork of the Gunnison. <br />BRL has not responded to this question yet. Please provide a response. <br />The operator revised page 2.05-73, adding a discussion of downstream impacts. This <br />revision brings up several more questions. <br />9a. On proposed revised pages 7.04-37 and 2.05-73, it is stated that any signifrcant <br />mine water discharge would need to be transported over the Deer Trail Ditch and <br />Fire Mountain Canal in order to avoid water gzral ity degradation. No structures <br />are in place right now to prorert the rater in the Deer Trail Ditch and Fire <br />Mountain Canal from significant mine water discharge. Rule 2.05.6(3)(a)(1) <br />requires that protection of surface and ground water within the permit area and <br />the adjacent area be ensured. Please revise the permit to state that Bowie will <br />build such structures. In addition, "significant "is not defrned. Wha[ monitoring <br />rnethoil will Bowie Resources employ to determine when the mine water <br />discharge is significant and needs to be transported over the Deer frail Ditch and <br />the Fire Mountain Canal ? <br />BRL changed the wording from "significant" to "continuous" in the submittal <br />dated May 12, 1999. However, the Division is requesting that BRL define the <br />methodology it will use to determine when the mine tivater discharge can be <br />dischazged into the Fire Mountain Canal and when the mine water dischazge <br />should be piped over the canal and to the North Fork of the Gunnison River, <br />without injuring the rights of users of the canal water or the river water. This <br />methodology should take into account the quantity and quality of the mine water <br />discharge and the quantity and quality of the receiving water, as well as the <br />frequency of any hydrologic monitoring. The methodology should aEso consider <br />availability of the hydrologic data by users of the canal water and notification of <br />13 <br />
