(~~n~~J Sc,hc~~e~ <br />Responses aze provided to the Adequacy Review dated Apri126, 2007. All <br />responses aze in bold. <br />1. As required by Rule 1.6.2(1)(d), please submit the proof of publication of the <br />public notice circulated in the local newspaper, all owners of record of surface <br />lands that aze within 200 feet of the boundary of the affected land, and any <br />easement holders. Proof of notice may be return receipts of a Certified Mailing or <br />by proof of personal service. <br />Enc-osed is the proof of publication. There were no notices sent to adjoining <br />landowners. The Bennetts own two half sections on either side of the pit <br />area. There are no known easement holders in the pit area. <br />2. Rule 6.3.2 Exhibit B -Site Description <br />The applicant states that an existing pit is already located on site and that <br />Mr. Bennett should not be held to creating a 3:1 slope back to the wedge <br />of the right-of--way of Road BB. Please further explain the existing pit and <br />the various slopes. Please provide photographs and detailed drawings on <br />one if the exhibits of the disturbed area. Please be aware that if the slopes <br />are re-affected by Mr. Bennett during the proposed operation, then <br />reclamation of the slope under this permit would be required. <br />After paying another visit to the site, the concern originally expressed over a <br />slope of 3:I back to the edge of the right-of--way of Co. Rd. BB is unfounded. <br />The existing slope in that area is not as steep as explained in the reclamation <br />note. There should not be an issue meeting the proposed 3:1 slope as <br />originally proposed in the reclamation plan. A picture showing the site from <br />south to north shows the area that will be mined. The picture does show two <br />
