3. As noted in the Division's letter of December 3, 2003, to Mr. $ruce Johnson, with a cc to <br />Randy Schafer, proof of notice in a newspaper and proof of mailings must be submitted to the <br />Division of Minerals and Geology prior to the decision date. <br />Response -Attached are copies of the proof of publication in a local newspaper and <br />proof of mailings to the adjoining landowners. <br />4. For the Applicant's and other interested parties information, the following stipulation is now <br />included in all Reclamation Permit and Conversion approvals: <br />A reportable spill is a spill of any toxic or hazazdous substance (including spills of <br />petroleum products) within the mined land permit area reportable to any Division of the <br />Colorado Department of Public Health and the Environment, the Nation Response Center, <br />the Colorado Emergency Panning Committee, or the State Oil Inspector. <br />The Mine Operator shall notify the Division of Minerals and Geology (DMG) of a <br />reportable spill within the mined land permit area using the same timeframe required by the <br />permit, license, notice, statute, rule or regulation governing the reporting of the spill to the <br />other appropriate agency. Notice of a reportable spill shall be faxed to: Minerals Program <br />Supervisor, Division of Minerals and Geology, FAX (303) 832-8106. The FAX shall <br />include a callback number of responsible company official for DMG staff to use a contact. <br />Response -Washington County is now aware of your requirement for reporting any <br />spills of toxic or hazardous substances at this gravel pit site to the Minerals Program <br />Supervisor, in addition to other required parties. Appropriate action will be taken if <br />such a spill occurs. <br />Please let me know as soon as possible if any additional information is needed.
