S ~
continue to cause severe bank erosion on my property as well as to the
properties immediately to the south of me on the east bank of the Animas. I also
question the commitment that the extraction process will not go below 6445' in
elevation. My COE certificate says I'm at 6703'. That's a 260' different that
leads me to believe that FCM is fudging the numbers. Also, on Exhibit K, the pit
is designated as being at 6675'. Does this mean that they are going to dig a hole
in the river 230' deep and really create some up stream erosion?
Finally, on page 7 of the document, reference is made to the Wright-
Mclaughlin Engineers report done in January 1981 encompassing the Animas
River from Baker's Bridge to the Bar D pit. The application states, "The upper
part of this study was still 3 miles south of the Thomas Pit". That statement is flat
wrong. This error plus several others I've pointed out lead me to wonder about
the overall credibility of Greg Lewicki and Associates. I've reviewed the above -
mentioned report and quite frankly, I think that Mr. Lewicki is taking liberties in
using the report to defend his position that a gravel operation is good for the
river!
In the overall scheme of things, granting this permit is not good. Even
though you may be focused on the mineral and geology aspects of this
application, from a social and conservation point of view, it would be wrong to
issue the permit withput addressing the points in this letter in a public forum and
extending the comment period until May 6, 2002.
rds,
Dennis ierce,~
11317 CR 250
Durango CO 81301
cc: Monte Potter, Four Corners Materials, Inc.
Leslie McWerter, Army Corp of Engineers
Dick Langoni Colorado Dept of Transportation
Joe Crain, La Plata County Planning
La Plata County Commissioners
Colorado Water Resources Division
Bill Roberts, DURANGO REARED
Dan James, James Ranch
Rick Mayo, Vega Verde Ranch
Electa Draper DENVER POST
Milan McMannis
Ronald Ritz MD
