Cattany Division Director The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on June 2, 2003, an application to revise coal mining operations at the Bowie No. 2 Mine was considered complete for the purposes of filing. The revision was submitted by Bowie Resources Limited. AlI review and comment periods as provided in the Act and the Regulations initiate from this date of filing. Bowie Resources is requesting permission to use a clarification agent to ensure that the dischazge from Pond C will be in compliance with water quality requirements. The clarification agent is NALCO 7880, which contains aluminum chloride hydroxide and calcium chloride. The clarified water would flow from Pond C into the Deer Trail Ditch and the Fire Mountain Canal. The Colorado Water Quality Control Division has approved the use of the clarification agent for this purpose at the Bowie No. 2 Mine. The underground coal mining operation is on land located approximately 5 miles northeast of Paonia, Colorado. The permit azea is further described as follows: Portions of Sections 2, 3, 4, 5, 8, 9, 10, 11, 14, 15, 16, and 22, Township 13 South, Range 91 West of the 6th P.M. Portions of Sections 33 and 34, Township 12 South, Range 91 West of the 6th P.M. The above-mentioned tracts of land aze shown on USGS 7.5 minute Quadrangle map of Bowie. Because the above referenced technical revision application would alter previously approved permit conditions or mitigation measures, we aze requesting your agency's evaluation of the proposal. Your comments and concerns relating to the adequacy of fish and wildlife resources information, the fish and wildlife plan, and the reclamation plan as it relates to fish and wildlife considerations, including potential impacts to threatened or endangered species, aze requested. Applicable sections of the technical revision aze enclosed. Please advise us if you require additional information.
