MCC is aware that a few of the projected B-seam longwall panels are depicted to extend beyond the current lease and/or permit boundaries. MCC intends to obtain all appropriate rights-to-enter and permits prior to mining these particular panels. Also keep in mind that in the case of the southern-most Apache Rucks panels, mining is not scheduled to begin until 2016. MCC will provide the Division with the BLM approvals when they are received. [n addition, enclosed with this response are additional changes to permit text, exhibits and maps. These changes have occurted since the permit revision application was submitted to the Division in February 1998. The enclosed documents include: Exhibit 1: Revised Officers and Directors for MCC, L.L.C, Arch Coal, Inc., Ark Land Company, Arch Western Acquisition Corporation, and Arch Western Resources, L.L.C. to reflect the sale of MCC to Arch Coal, Inc. from ARCO. In addition, the list of Officers and Directors of ARCO have been removed from Exhibit 1, as ARCO only retained aone-percent interest in MCC afrer the sale; and, therefore, do not qualify as an Owner and Controller as defined at 1.04(83a). A separate table includes the beginning and ending dates of the Officers and Directors. Exhibit 2: Revised Surface Owners, Mineral Owners, and Leasehold and Royalty Interests with current information. The list of ROW Easements and Miscellaneous was removed from the Exhibit because this list includes who has requested a ROW Easement from MCC and who has grazing leases with MCC, which is not information required by the Regulations.
