<br />2 <br />The enclosed materials addressing the five items above are <br />submitted for review by AFO. The operator is compiling results of <br />sediment pond surveys in conjunction with the approved methodology <br />for determining sedimentation from the site. Pending review of <br />those results, the DMG feels that all of the outstanding issues <br />identified by AFO in its nonconcurrence with DMG's proposed <br />decision to approve the bond release have been adequately <br />addressed. DMG would like to suggest that review of the enclosed <br />materials begin as soon as possible. Results of the sediment pond <br />surveys should be forwarded in approximately two weeks. If you or <br />your staff have any questions about the enclosed materials, please <br />have them contact me. <br />I. Verification that DMG inspected the entire mine site. <br />DMG's October 20, 1992 bond release inspection report includes a <br />statement saying, "Attempts to verify topsoil depths at the Rienau <br />No. 2 Mine on October 20 and 22 were not successful since access to <br />the land was denied." The land owner told the DMG inspector he did <br />not want her to enter his land that day. However, the site was <br />inspected on that day as well as on other occasions by DMG <br />inspectors in relation to the Phase II bond release request. The <br />point of the Phase II inspection was to verify topsoil replacement <br />depths, vegetative cover and erosional conditions. These topics <br />were inspected and reported on, as follows: <br />1. The DMG conducted a very thorough inspection of the <br />Rienau site on July 13, 1992 at which time vegetative <br />cover transects were sampled by two DMG inspectors. This <br />inspection was conducted after DMG was notified of the <br />operator's intent to request a bond release and in <br />conjunction with vegetation sampling done by the <br />operator. Four 50 meter transects were sampled at one- <br />meter intervals on the Rienau area. A copy of that <br />inspection report is enclosed. <br />2. During the October 20, 1992 inspection, the DMG <br />inspector inspected the Rienau site from the edge of the <br />reclaimed area. The reclaimed area at the Rienau site is <br />approximately 125 feet wide through most of the area. At <br />its widest point, it is approximately 350 feet wide and <br />on 2h:ly and 3h:ly slopes. The entire area can be <br />visually observed from several locations. Photos taken <br />by the DMG inspector on October 20, 1992 are available. <br />The October 20, 1992 inspection report indicates that the <br />slopes at the Rienau area were inspected and includes a <br />description of the condition of and water levels in the <br />Rienau sediment ponds.
