(Deposition of James Tatum)
1 the June 1st letter agreement,
2 A. We never contempla
3 going to give up that superior
4 this deal, that their superior
5 remain in place.
6 (The Reporter marked
7 Deposition Exhibit 31.)
were you?
ted that they were
priority right in
priority right would
for identification
8 Q. Mr. Tatum, I have handed you Exhibit
9 31, which is an October 24, 1989, letter from you
10 to Bill Garner. The second page of that document
11 appears to be a file copy of the same letter, but
12 it's a lot more readable than the original, and if
i
13 you are having trouble reading the original you
14 might try reading the file copy. My question is,
15 what is the relationship of the second paragraph to
16 the June 1st, 1988, agreement?
17 A. I don't understand your question.
18 Q. Well, the June 1st, 1989, agreement
19 talks about exchanging two CFS for two CFSs or
20 trading two CFS for two CFS. This second paragraph
21 in Exhibit 31 talks about exchanging three point
22 five CFS and it seems to contemplate a somewhat
23 different deal?
' 24 A. No, I'm,just saying that I would not
25 transfer three point CFS, or whatever.
MEEK & ASSOCIATES
3016 3rd Ave., Pueblo, Co 81008 (719) 542-1010
29
