Our interest, as we told you, was to involve the State Engineer's office eazly in
the process of permit amendment review by DMG and to seek your guidance relative to your office's
review of proposed site reclamation involving raw water storage reservoirs. Aside from expressing
our gratitude for your interest and involvement, this letter also provides an opportunity to summazize
our understanding of your input from the meeting, obtain clazification if necessary, and inform DMG
that we have met with you to discuss the project.
Following introductions and an informal overview presentation by Cooley representatives about the
annexation of the quarry into the Town of Morrison, and about the conceptual design of proposed raw
water storage reservoirs, several discussions ensued concerning existing conditions at the quarry,
substitute supply plan requirements, potential additional design requirements and miscellaneous related
subjects. The following points were noted by Cooley:
• The State Engineer review of the permit amendment will deal with potential jurisdictional dam
safety and water rights issues.
• New general criteria for substitute supply plans aze available in draft form and should be
consulted when the substitute supply plan for the site is modified.
• Seepage criteria in SB120 do not apply to the site because it is a hazd rock quarry not a sand
and gravel quarry sited in tributary alluvium.
• Once a persistent water table is encountered during future mining, and NPDES dischazge
dewatering begins, the State Engineer wants to ensure protection of downstream water rights
on both Bear Creek and Turkey Creek.
ID8135.1q
1600 8roadwav
Suite 1125
Demer,C0 H0202 Offices Scarbnrnuv;h, blame Rcnhecter. .Veer lock
Tel: 303/33?-9636 Cambrtd,Ge. blas..uhusetb Sil cer Senn„1•lanimld Cle~'cland, Ohio
Fax: 303/832-Y616 Glustonbun•, Gmnd~ucut Na11on1. \e+~ H, mp>hire
