ATTACHMENT TO NOV CV-2007-002 <br />NATURE OF VIOLATION: <br />Failure to design, construct, and/or maintain permanent reclamation slopes and features <br />including segments of postmine drainage channel and segment of light use road and <br />associated ditching, as necessary to: <br />• Minimize erosion to provide protection for topsoil and vegetation [4.05.5(1)(c)]; <br />• Minimize erosion and slippage [4.14.2(5)]; and <br />• Prevent damage to public or private property [4.03.3(1)(a)]. <br />ACT, REGULATION, OR PERMIT PROVISION(S) VIOLATED: <br />REGULATION <br />SECTION(S) Rule 4.03.3(1)(a); Rule 4.05.5(1)(c); Rule 4.14.2(5). <br />PERMIT <br />SECTIONS Drainage designs as depicted in the following permit sections: <br />• Exhibit 20-2; <br />• Attachment 20-B, Appendix D, Figure 1 (Sheet 1 of 3) <br />• Attachment 20-1 (p. 20-1-206) <br />• Permit Tab 13, page 37 (Typical Light Use Road Section) <br />PORTION OF THE OPERATION TO WHICH THIS NOTICE APPLIES: . <br />The NOV was written due to the occurrence of a small slide and associated erosion that <br />resulted in disturbance/damage to a small area of land that had not been approved for <br />disturbance, and which had not been cleared of vegetation or stripped of topsoil. The <br />slide apparently occurred in late March or April, during snow melt. The slide occurred <br />approximately 150 feet north of Culver[ PM-10, on the outslope of the "Ridgeline Light <br />Use Road", which runs along the ridgeline on the eastern margin of the reclaimed area, <br />between reclaimed "Neck Pit" upland slopes immediately to the west, and steep <br />undisturbed slope immediately to the east. The general area as it appeared prior to the <br />slide is shown from various perspectives in photos from August 2006 (DSC02767), <br />October 2006 (DSC0412}, and February 2007 (DSC0220). Detail photos DSC02985 <br />through DSC02993 were taken of the subject area during the inspection of Apri125, <br />2007. <br />Approved topography and drainage features in the slide vicinity are depicted on permit <br />map Exhibit 20-2 (Postmining Topography and Drainage), and in more detail on Figure <br />1, Sheet 1, of Attachment 20-B, Appendix D (2006 Neck Pit Landslide Remediation <br />Planview).
